1. Who we are and what this covers
Cherry Hosting ("Cherry", "we", "us") sells Minecraft: Java Edition game server hosting. The service includes the servers themselves, the web-based game panel, and the client area where you manage billing. By creating an account, ordering a plan or starting a trial, you agree to these terms.
2. Your account
- You must be at least 13 years old, or the minimum age required in your country to use online services.
- Give us accurate details and keep your login private. You are responsible for what happens under your account.
- When you order, we create your game panel login automatically and send it to the email on your account.
3. Minecraft and third-party software
Cherry Hosting is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. You must follow the Minecraft EULA and Mojang's commercial usage guidelines. You are responsible for holding the rights to any jars, plugins, mods, modpacks and worlds you upload.
4. Acceptable use
You may not use your server to:
- attack, scan or disrupt other systems or networks, including denial-of-service traffic of any kind;
- host or distribute malware, phishing pages, or anything illegal where you or we operate;
- infringe copyright or other rights, including distributing pirated plugins or content;
- mine cryptocurrency or run workloads that are not a Minecraft server or its direct support tools;
- use so many resources that it harms other customers on the same machine.
If you break these rules we can remove content, suspend or terminate the service, and report illegal activity to the authorities.
5. Plans, billing and renewals
- Plans and prices are listed on our website and in the client area, in US dollars.
- Plans are billed monthly in advance by card through Square, and renew automatically each month until you cancel.
- If a payment fails we will tell you and try again. If it stays unpaid the service can be suspended.
- If we change a price, the new price applies from your next billing period and we will tell you before it does.
6. Cancellations and refunds
You can cancel at any time from the client area. Your server stays online until the end of the period you have already paid for, and cancelling stops the next renewal.
Refunds: you can ask for a refund within 3 days of a payment, by opening a support ticket in the client area. After 3 days, payments are not refundable, and cancelling does not refund the period you have already paid for. Refunds go back to the card that was used.
7. Free trial
The free trial lasts 24 hours and is limited to one per person. We can end a trial early or refuse one if we suspect abuse.
8. Availability and maintenance
We work to keep servers online, but we cannot promise the service will be uninterrupted or error-free. We may need to do maintenance, and network-level DDoS filtering lowers the risk of attacks but cannot remove it entirely. Servers are currently hosted in Dallas, Texas.
9. Backups and your data
Your worlds and files belong to you, and you are responsible for keeping copies. The panel lets you create, download and restore backups yourself; we recommend taking one before updating Minecraft or adding large plugins. We do not guarantee that any backup will always be available. Download what you need before cancelling. Your server's files are deleted when your service is deleted in our billing system, which happens after a service has been cancelled or has expired unpaid.
10. Suspension and termination
We can suspend or end your service if you break these terms, do not pay, put other customers or our systems at risk, or if the law requires it. You can stop using the service at any time. When a service ends, you lose access to the server and its files.
11. Limits on our liability
The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing here limits rights you have under the law that cannot be limited.
12. Changes to these terms
We may update these terms. If a change is significant we will tell you by email or on the website before it takes effect. Using the service after a change means you accept it.
13. Governing law
These terms are governed by the laws of Canada, without regard to conflict-of-law rules.
